Never mind.  Figures I would find a brand new copy today while at EB.  Now I just hope the guy honors his own refund policy.

1) sort of a grey/beige on the right and left sides, fading as it gets into the middle

2) mine has a 07 and an E3 on the right side of the label

Thanks for the confirmation Kirin.  I hadn't seen a copy of this game for a while, so I didn't think I would just find one sitting at EB.  O_o  Anyway, the game I was sent has a red background and some other inconsistencies (e.g. missing trademark, wrong ESRB rating, no indented numbers/letters on the front) so looks like I got a...lemon (sorry, that was horrible).  Thankfully the seller seems to be cooperative so I won't be out too much in the end.
